1. Acceptance of Terms

By using the Services, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree with these terms, you must discontinue use of the Services immediately.

2. Medical Disclaimer

XYFitAI provides fitness, nutrition, and wellness-related guidance through artificial intelligence. However, we are not medical professionals, and our Services do not provide medical advice.

  • You should consult a qualified healthcare provider before starting any exercise, nutrition, or health program recommended by XYFitAI.
  • The information provided by XYFitAI should not be used as a substitute for professional medical advice, diagnosis, or treatment.
  • Use of XYFitAI is at your own risk, and we are not liable for any injuries, health conditions, or damages arising from your reliance on our recommendations.

3. User Accounts and Eligibility

To use certain features of the Services, you may be required to create an account. You must provide accurate and complete information and keep your credentials secure. You must be at least 18 years old or have parental consent to use the Services.

4. Data Collection and Privacy

We are committed to protecting your privacy and ensuring transparency regarding how your data is collected and used. By using XYFitAI, you agree to the collection and processing of your personal data as outlined in this section.

4.1 Information We Collect

  • Personal Information: Name, email address, age, and any information you voluntarily provide when creating an account.
  • Health & Fitness Data: User-inputted fitness goals, weight, dietary preferences, and workout logs.
  • Device & Usage Information: IP address, device type, operating system, app usage metrics, and crash reports.

4.2 How We Use Your Data

  • To personalize workout and nutrition recommendations based on user input.
  • To improve the accuracy and effectiveness of AI-driven fitness guidance.
  • To provide customer support and respond to inquiries.
  • To prevent fraudulent activities and ensure app security.
  • To comply with legal requirements and enforce our terms.

4.3 Data Storage & Security

  • Encryption of sensitive data both in transit and at rest.
  • Restricted access controls ensuring only authorized personnel can view user data.
  • Regular security audits to prevent unauthorized access, breaches, or data leaks.

5. License Grant

Subject to this Agreement, XYFitAI grants you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

  • You may not modify, distribute, sublicense, or reverse-engineer the App.
  • Unauthorized commercial use is strictly prohibited.

6. Subscription and Fees

XYFitAI operates on a subscription-based model:

  • Fees are billed monthly or annually as selected during sign-up.
  • Payments are non-refundable. You may cancel your subscription at any time, but no refunds will be issued.
  • Your subscription will automatically renew unless canceled prior to the renewal date.

7. Intellectual Property Rights

XYFitAI and all related materials, trademarks, logos, and content are owned by Douglas & Arnold LLC. Users may not copy, modify, distribute, or commercially exploit any aspect of the Services without explicit written permission.

8. User Responsibilities

By using XYFitAI, you agree to:

  • Use the Services only for lawful purposes.
  • Not misuse, exploit, or attempt to hack the Services.
  • Not distribute misleading or false health information.

9. Disclaimers and Limitation of Liability

The Services are provided 'as is' and 'as available.'

  • No Guarantees: We make no warranties regarding the effectiveness, accuracy, or completeness of any recommendations made by XYFitAI.
  • Limitation of Liability: To the fullest extent permitted by law, XYFitAI and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

10. Termination

We may suspend or terminate your access to the Services at any time for violating this Agreement. Upon termination, you must cease all use of the App.

11. Governing Law

This Agreement is governed by the laws of the State of Illinois. Any disputes shall be resolved exclusively in the courts of Illinois.

12. Changes to the Agreement

We may update this Agreement periodically. Continued use of the Services after updates constitutes acceptance of the revised terms.
